BISHOPS SECURE HIGH COURT HEARING FOR INFERTILITY CASE
The Australian Catholic Bishops have expressed their approval of the decision of Justice Ian Callinan of the High Court to hear the Church's application for orders concerning the Federal Court decision known as McBain vs. State of Victoria.
The July ruling of the Federal Court in favour of the right of single women to infertility treatment has, in the view of the Bishops, cast a shadow of the integrity the institution of marriage and the family.
President of the Australian Catholic Bishops' Conference, Archbishop Francis P. Carroll said: "The Catholic Church looks forward to advancing arguments of law, especially concerning the rights of children, before the Full Bench some time in the future."
The Bishops' Conference had made application yesterday to the High Court seeking to have the decision in McBain v. State of Victoria quashed and the matter reheard.
It is advancing arguments similar to those in the McBain case, where, as a 'friend of the court', the Catholic Church in Australia sought to defend and protect the fundamental rights of the child.
